Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Retiretainment, LLC, a Delaware limited liability company ("we," "us," "our"), governing your access to and use of waterdrome.com and related features (the "Service"). By accessing or using the Service, you agree to these Terms, our Acceptable Use Policy, our Disclaimer, and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract. If you use the Service for an organization, you represent that you are authorized to bind it, and "you" includes that organization.

2. Nature of the Service; informational only

The Service is an informational directory and commercial marketplace for seaplane bases and related services. It is not an official, authoritative, or approved source of aeronautical, navigational, weather, regulatory, or safety information, and we are not affiliated with or endorsed by any government agency or aviation authority. Content may be inaccurate, incomplete, or outdated, and much of it is contributed by users or supplied by third parties and is not verified by us.

3. No operational reliance; assumption of risk

You agree that you will not use the Service for flight planning, navigation, takeoff or landing, fuel planning, or any operational or in-flight decision, and that you will rely solely on official sources and your own authority as pilot in command. Seaplane operations are inherently dangerous and can cause property damage, serious injury, or death. You knowingly and voluntarily assume all risks arising from aviation and from any use of or reliance on the Service.

4. Accounts

You are responsible for your account, the accuracy of your information, the security of your credentials, and all activity under your account. Notify us promptly of any unauthorized use. We may refuse, suspend, or terminate accounts at our discretion.

5. Acceptable use

Your use is governed by our Acceptable Use Policy, which is incorporated here. Violations may result in content removal, suspension, or termination.

6. User contributions

"User Content" means anything you submit, including conditions reports, fuel prices, seasonal access notes, approach and departure notes, reviews, photos, listings, and messages.

  1. License. You retain ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (for formatting and moderation), display, distribute, and otherwise use your User Content to operate, promote, and improve the Service. This license survives termination for content you have shared publicly.
  2. Your representations. You represent that you own or have the rights to your User Content, that it is your genuine good-faith observation, and that it does not infringe any rights or violate any law or our Acceptable Use Policy.
  3. No verification; not our content. We do not verify, endorse, or adopt User Content. User Content reflects the views of the contributor, not us. You acknowledge that User Content may be inaccurate, stale, or mistaken, and that you rely on it at your own risk.
  4. Moderation. We may, but are not obligated to, review, edit, label, refuse, or remove any User Content, and we are not liable for User Content or for any action or inaction regarding it.
  5. Feedback. If you send suggestions, we may use them without restriction or obligation to you.

7. Provider listings and paid services

  1. Listings. Providers may create or claim listings. You represent that you own or are authorized to manage the business, that your information is accurate and current, and that you hold any licenses or permits your services require. We may require verification of ownership, and may refuse, edit, or remove any listing.
  2. Fees and billing. Paid listings (for example, featured placement) are billed through our third-party payment processor (Stripe). We do not collect or store full payment card details. You authorize the applicable fees, including any recurring charges until cancelled. Prices may change with notice for future terms.
  3. Renewals and cancellation. Paid listings may be sold as one-time placements or as subscriptions. Subscriptions renew automatically for successive terms until you cancel. You may cancel at any time from your account or by contacting us. Cancellation takes effect at the end of the current paid term, your listing stays active through that term, and the subscription will not renew after it.
  4. Refunds. You may request a refund within 7 days of a purchase. After 7 days, fees are non-refundable. For subscriptions, cancelling stops future renewals, and we do not refund or prorate the current term after the 7-day window, except where required by law.
  5. Taxes. You are responsible for any taxes other than taxes on our net income.
  6. No guarantee of results. We do not guarantee any level of traffic, views, clicks, inquiries, leads, bookings, or revenue from a listing.

8. Leads and inquiries

The Service may pass user inquiries to providers. We are not a party to any transaction, communication, or agreement between users and providers, do not guarantee any response or outcome, and are not responsible for the conduct, services, safety, or qualifications of any provider or user. You deal with other parties at your own risk.

9. Third-party content and links

The Service displays or links to third-party content, including webcam feeds and imagery provided by Windy, weather data, operator websites, and government resources. We do not control and are not responsible for third-party content, and your use of it may be governed by the third party's own terms. Webcam imagery is provided by Windy and subject to its terms.

10. Informational guides

Guides on invasive species decontamination, permits, and cross-border customs are general information, not legal or regulatory advice. Requirements change frequently and vary by location. Confirm current rules with the relevant agencies before acting.

11. Intellectual property

The Service, including its design, text, graphics, data compilations, and software, is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, scrape, reproduce, or create derivative works except as expressly permitted.

12. Copyright complaints (notice and takedown)

We respond to notices of alleged copyright infringement. If you believe content infringes your copyright, see our DMCA Notice & Takedown page for instructions and our designated agent's contact information. We may remove the material and terminate repeat infringers.

13. Disclaimer of warranties

THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY CONTENT IS ACCURATE, CURRENT, OR COMPLETE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH, ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR ANY CONTENT, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD 100.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

15. Indemnification

You will indemnify, defend, and hold harmless us and our officers, members, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, your violation of these Terms or any law, or your infringement of any third party's rights.

16. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we handle personal information.

17. Suspension and termination

We may suspend or terminate your access at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including Sections 3, 6, 11 through 15, and 18.

18. Governing law and dispute resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. (Retiretainment, LLC is organized in Delaware. That governs the company's internal affairs, not disputes between you and us under these Terms.)

Informal resolution. Before filing any claim, you agree to contact us at admin@retiretainment.com and work with us in good faith to resolve the dispute informally for at least 30 days.

Venue. If a dispute is not resolved informally, you and we agree it will be brought exclusively in the state or federal courts located in Contra Costa County, California, and both parties consent to the personal jurisdiction of those courts.

19. Changes

We may modify the Service or these Terms. If we make material changes to the Terms, we will update the date above and provide reasonable notice. Your continued use after changes take effect means you accept them.

20. General

These Terms, with the documents they incorporate, are the entire agreement between you and us regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them. We are not liable for delays or failures caused by events beyond our reasonable control.
